By accessing or using Be a Part, you agree to these Terms. If you do not agree, please do not use the platform. Some services or offers may include additional conditions shown before you use or purchase them.
Eligibility and accounts
Anyone may browse the public website. To create an account, you must be at least 16 years old or have permission from a parent or legal guardian. You must provide accurate information, keep your login details confidential, and promptly tell us if you believe your account has been used without permission.
You are responsible for activity carried out through your account. We may restrict, suspend, or close an account where reasonably necessary to protect the platform, its users, or third parties, or where these Terms or applicable law have been breached.
Acceptable use
You must not use the platform to:
break the law, infringe intellectual-property or privacy rights, or mislead other users;
publish unlawful, abusive, hateful, discriminatory, defamatory, obscene, or harmful material;
impersonate another person, manipulate platform activity, or engage in fraud;
introduce malicious code, bypass security measures, scrape the platform without permission, or disrupt its operation; or
use Fiolex characters or artwork beyond the rights granted on the License page or in a separate written agreement.
3. Your content and Creations
You retain any rights you hold in original content that you submit or create. You confirm that you own the content or have all permissions needed to upload, adapt, display, and share it, and that it does not violate another person’s rights.
When you submit content, you give Fiolex a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for technical presentation, display, and promote that content as reasonably necessary to operate and showcase the platform. This permission lasts while the content is available on the platform and for a reasonable period in backups and previously published promotional material.
We may remove or restrict content that breaches these Terms, applicable law, or the rights of others. We do not guarantee that submitted content will be published, promoted, or kept available indefinitely.
4. Patrons and Creators
Patron and Creator features may offer benefits such as early access, recognition, community participation, creative tools, certificates, or affiliate opportunities. The benefits available for a particular programme or Original will be described with that offer and may change as the platform develops.
Participation does not transfer ownership of Fiolex intellectual property unless an explicit written agreement says otherwise. Affiliate commissions, audience reach, sales, and income are not guaranteed. Any applicable eligibility rules, commission rates, payment thresholds, or programme-specific conditions will be disclosed separately.
5. Transactions, payments, and wallets
Prices, currencies, fees, quantities, delivery information, and other material transaction details will be shown before confirmation. You are responsible for checking those details and for any taxes or third-party charges that apply to you.
Payments, digital wallets, blockchain networks, and related services may be provided by third parties under their own terms and privacy policies. Blockchain transactions may be public and irreversible. Fiolex cannot reverse a transaction controlled by an external wallet, network, or provider.
Delivery, cancellation, and refund rights depend on the specific offer, the nature of the product or service, and applicable mandatory consumer law. Nothing in these Terms limits rights that cannot legally be excluded.
6. Intellectual property
The platform, Fiolex names and branding, characters, illustrations, software, text, audio, video, and other materials are owned by Fiolex or their respective rights holders and are protected by intellectual-property laws.
Access to the website does not grant permission to commercially use, resell, distribute, or create derivative products from Fiolex artwork. The separate License Rights page explains the available artwork licences and permitted uses. Where an offer has specific licence terms, those specific terms apply in addition to these Terms and take priority for that licensed material.
7. Availability, changes, and external services
We aim to keep the platform available and accurate but cannot promise uninterrupted, secure, or error-free operation. Features, content, benefits, and availability may be updated, suspended, or discontinued. Where a change materially affects an existing paid commitment, we will respect applicable law and any specific terms agreed for that commitment.
Links and integrations may lead to third-party websites or services. Fiolex does not control and is not responsible for their content, availability, security, or practices. You should review their terms before using them.
8. Disclaimers and liability
The platform is provided on an “as available” basis. To the fullest extent permitted by law, Fiolex excludes warranties that are not expressly stated and is not liable for indirect or consequential loss, lost profits, lost data, or losses caused by third-party services, wallets, networks, or events outside our reasonable control.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including mandatory consumer rights or liability for intent or gross negligence. If your unlawful use of the platform, your content, or your breach of these Terms causes a third-party claim against Fiolex, you are responsible for the resulting reasonable losses and costs to the extent permitted by law.
9. Changes, governing law, and severability
We may revise these Terms as the platform or legal requirements change. The current version and revision date will be published here. Material changes will apply prospectively and, where reasonably possible, will be communicated through the platform.
These Terms are governed by Swiss law, excluding its conflict-of-law rules. Subject to any mandatory consumer forum, the courts of Baden, Switzerland have exclusive jurisdiction.
If any provision is found invalid or unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
